Google settles legal dispute with publishers ? The Judge Ben C ...

On Thursday, October 4, the Association of American Publishers (AAP) and? Google Inc. announced?a settlement in their?seven year old litigation over Google?s massive book scanning and?digital library building? project. The AAP sued in 2005 when Google began its project to build a digital library by scanning and making available digital copies of previously copyrighted works.

Claire Miller, reporting for the New York Times, states that ?the deal allows publishers to choose whether to allow Google to digitize their out-of-print books that are still under copyright protection. If Google does so, Google will also provide them with a digital copy for their own use.?

Although some details of the settlement have not been disclosed, AAP?s website? quotes Google Senior Vice President and Chief Legal Officer David Drummond:

By putting this litigation with the publishers behind us, we can stay focused on our core mission and work to increase the number of books available to education, excite and entertain our users via Google Play? Google Books allows users to browse up to 20% of books and then purchase digital versions through Google Play. Under the agreement, books scanned by Google in the Library Project can now be included by publishers.

Claire Miller?s?New York Times article, ?Google and Publishers Settle Over Digital Books,? explains the status of the current litigation:??The settlement between Google and the publishers is a small part in the transition to e-books? The bigger case, between Google and the Authors Guild, remains tied up in court.? On its website, the Author?s Guild acknowledges the AAP?s private settlement but emphasizes that whatever the terms, it does not resolve the authors? copyright infringement claims against Google. In a statement, Guild executive director Paul Aiken said: ?Google continues to profit from its use of millions of copyright-protected books without regard to authors? rights, and our class-action lawsuit on behalf of U.S. authors continues.?
